What you need to know

Advertising and marketing guidelines in New York State, including New York City, are overseen by the New York State Cannabis Control Board (CCB). The comprehensive regulations are available for review on the CCB website.

Here’s what you need to know:

  1. Avoid creating marketing materials that might appeal to individuals under 21, which includes refraining from using vibrant colors, cartoon characters, child-friendly language like “candy,” and fonts with a youthful appearance, such as bubble letters. Additionally, exercise caution when featuring images of individuals who could be perceived as under 21.
  2. For adult-use cannabis dispensaries, it’s important to note that making health claims is prohibited, even if supported by third-party scientific studies and other reliable sources.
  3. While “reasonable” marketing is permitted, it must not compromise public health or safety, encourage youth use, or be attractive to those under the age of 21. Licensees must also demonstrate that at least 90% of their marketing efforts are directed toward an audience aged 21 and older. One common practice to ensure marketing does not target those under 21 is use of an age gateway on the company’s website.
  4. Sponsorship of events or charitable organizations is acceptable, provided that the promotion of their participation falls in line with the Office of Cannabis Management (OCM) regulations.
  5. Promotion of prices, price reductions, and the use of loyalty programs is not allowed.
  6. Certain types of advertising, such as billboards, are not allowed. The regulations also restrict ad placement, which means that some mediums like car wraps are not allowed by default.

In addition, the following statements must be included:

“For use only by adults 21 years of age and older. Keep out of reach of children and pets. In case of accidental ingestion or overconsumption, contact the National Poison Control Center hotline 1-800-222-1222 or call 9-1-1. Please consume responsibly.” Alternatives to this statement may also be required depending on the advertisement.
